CITY COUNCIL MEETING

June 24, 2009

The Mayor called the meeting to order at 6:00 p.m.  The roll was called, Jim Munyon being
absent (arrived later.)  The pledge of allegiance was recited.

The minutes of the June 10, 2009 meeting were considered.  It was noted that there was a
discrepancy on line 17 of page 3 and that “All members were in favor” be struck from the
minutes.  MSP:  To approve the June 10 minutes as corrected, Frank Primozic/Bill
Harrington.   Horrell, McKinley, Coe, Garrison, Harrington, Primozic and Munyon voted in
favor, none were opposed.

The June 18 Special Meeting minutes were considered.  MSP:  To approve the June 18
minutes as written, Bill Harrington/Carole Garrison.  Horrell, McKinley, Coe, Garrison,
Harrington, Primozic and Munyon voted in favor, none were opposed.

Frank Primozic referred to the prior meeting wherein it was agreed he would act as
Committee Head to the museum staff and suggested the Mayor talk to the Curator and
advise her of the decision and his role.  The Mayor agreed to communicate it to her.

Planning:  no report

Public Safety:  Chief Oxford reported that he had talked with the Sheriff about donating
one of the Durangos specifically to be used by the posse and search and rescue, but was
told that they would not accept the vehicle with conditions attached.

Oxford also reported that he had given the Mayor a completed policies and procedures
manual and a file containing a call out list if anyone wanted to review them.  He said the
proposed policy and procedure manual would be sent to the City’s Risk Management
advisor for review as well.

Abatement:  Chief Oxford reported that he had investigated the nuisance complaint
submitted by the Nunns and had found chickens at large on the Ford residence.  He also
said there was feces and urine on the Nunns’ property and porches that was creating a
stench.  He said he did not cite Ford but had turned over the information to the District
Attorney’s office for review to see if anything would be done.  He was asked if he had a
copy of the report.  He said no and that the report and complaint are out of the City’s
hands until the DA responds.  It was noted that previously there had been complaints and
that improvements had been made.  Oxford stated that everything that had been cleaned
up has re-appeared.  He said there were at least 50 chickens (when he was there) but that
there may be less now.  He also said that basically the problem is that they don’t stay in
the coup.

Carole Garrison said she had stopped by and talked with Ford and that things appeared
clean.  She said Ford told her she would be getting some meat chickens in 4 weeks and
that the 50 little chickens that had been there earlier were delivered by mistake but were
now gone.  Garrison said it was clean at the time she was there and that she didn’t detect
any odor.  She suggested that perhaps during the heavy rain an odor may have been
present.

6:20 Jim Munyon arrived.

The Mayor said he had noticed chickens outside the coup but did not state a specific date
or time.  There was discussion as to whether or not the chickens and eggs are for personal
consumption or for sale.  It was believed they are for personal consumption.

Tim Coe said he had seen some of the chickens at large for a couple of days but that Ford
has been up front about the situation.  He said he reminded her she needs to keep them
contained and she was cooperative.

There was more discussion and the Mayor read Section 8.04.110(1) of the City ordinance.
There was question of when Ford was in violation and whether or not she still is.  It was
agreed that the Council should wait to hear from the District Attorney on the issue.  MSP:

To reserve the complaint until the City hears from the DA to see how they proceed,
Bill Harrington/Jim Munyon.  Horrell, McKinley, Coe, Garrison, Harrington, Primozic and
Munyon voted in favor, none were opposed.

6:35 p.m.  Landfill:  Georgia Patterson said they had been keeping track of the time
involved in running the landfill in order to see if the tipping fee is sufficient.

Public Works:  Georgia Patterson reported that in the following week they would be
pulling the booster pumps and J-boxes to check the impellers and oil levels.  She explained
that the boxes need to be moved out of the wells for safety reasons.

There was discussion of the water system and that it is running smoothly.  She said the
sump pump was to be installed after July 4.  She also said the turbidity levels have been
very good.  There was discussion of the progress on the well being installed at Depot Park
for irrigation and it was suggested that a sign be posted noting that it is not potable
water.

Patterson thanked Carole Garrison for weeding the flower beds.

Recycling was brought up and it was noted that electronics would be collected at the
fairgrounds on Sunday the 28.  The Mayor wanted it noted that the City has not made any
deals with the new recycler and that the committee was meeting with the DEQ the next
morning.  It was noted that the recycler had not yet applied for a conditional use.

Accounts Payable:  MSP:  To pay the bills, Frank Primozic/Roger McKinley.  Horrell,
McKinley, Coe, Garrison, Harrington, Primozic and Munyon voted in favor, none were
opposed.

Resolution 2009-10 authorizing a budget transfer to cover museum personal services was
considered.  MSP:  To adopt Resolution 2009-10 transferring $1,600, Bill
Harrington/Carole Garrison.  Horrell, McKinley, Coe, Garrison, Harrington, Primozic and
Munyon voted in favor, none were opposed.

Other Business:  The decision regarding the continued employment of the Chief of Police
beyond his probation period was considered.  Bill Harrington made a motion that the
Chief be made a permanent employee on the anniversary date and requested the
Mayor appoint a Law Enforcement Supervisory Committee composed of the Mayor
and two Council members to deal with issues, operate by consensus, and report to
the Council in executive session on a quarterly basis.  Oxford interjected his suggestion
to add a citizen to the committee but the motion was not amended.  Frank Primozic
seconded the motion and it was put to a vote.  Horrell, Primozic and Harrington
voted in favor.  Munyon, Garrison, Coe and McKinley voted in opposition.  Motion was
defeated.

June 24, 2009

Tim Coe then made a motion that the Council vote yes to keep Randy or no for
ending his employment at the end of his probation period on June 30.  Jim Munyon
seconded the motion.  Bill Harrington stated that he had grave concerns about ending
what the Council had started, the interruption of service to the community and that the
Council has a responsibility to supervise and support its employees.  The Mayor said a lot
of work had gone into a document (policies & procedures manual) and that having local
law enforcement is important to the businesses.  The motion was put to a vote.
Harrington, Primozic and Horrell voted in favor of keeping Oxford.  Munyon,
Garrison, Coe and McKinley voted against keeping Oxford.

Garrison wanted it noted that it be understood that the work on the document hadn’t
gone unappreciated.
 7:20 p.m.  It was moved and seconded to adjourn the meeting.
