SPECIAL CITY COUNCIL MEETING

JUNE 7, 2006

Attended:

Joe Hitz, Engineer

Mayor Hamsher called the meeting to order at 6:00 p.m.  Roll call was called, all members being
present.  The pledge of allegiance was recited.

It was announced that the purpose of the meeting was to consider award of the well drilling bid
and to discuss the wastewater pump legal issue.

Three bids were received:

JWN $100,000
Marciel Well Drilling     $115,270
Boart Longyear/GeoTech  $229,450

Mike Springer made a motion to reject the JWN bid due to no submission of a Bidder’s
Certificate, late submission of the Bidder’s Perfomance and Payment Statement and the First
Tier Subcontractors Disclosure Form, and because the bid was not filled out in pen as required.
There was discussion and the attorney explained that these are all required by State law in order
to comply with the necessary standard for bids.  Tom McAuslan seconded the motion, all
council members voted in favor.

The Council then considered the remaining bids.  MSP:  To accept the bid of $115,270 from
Marciel Well Drilling, Mike Springer/Roger McKinley.  It was noted that drilling would most
likely begin at the end of the month.

The Council considered the wastewater pump failure issue and the attorney explained that she
and Council members McAuslan, Springer and McKinley had met earlier with the Bob Titus and
Georgia Patterson of Public Works.  She provided a checklist and summary of what must be
done in order to properly document pump failures.  It was noted that fact collection sheets are not
being provided by Public Works, notice requirements are not being met and no one is contacting
Anderson Perry regarding the failures.  She suggested meeting in executive session at the next

meeting to further discuss the city’s position with regard to legal remedy, but stressed the city
must follow notice requirements when ever there is a pump failure.  She said the next meeting
will be important in deciding how to proceed and facts are needed to determine causation.  Mike
Springer told the Council that Bob Titus and Georgia Patterson had been instructed to get their
files in order and up to date.  Tom McAuslan commented that they should have been keeping
records as instructed from the very beginning.  It was agreed they would meet in executive
session at the June 14 regular meeting.

There was some discussion of the property and access easements needed for the well drilling
project and the attorney said title reports should be obtained on the properties involved.  MSP:
To give Michelle Timko permission to authorize a complete title search on the Coombs
property, Mike Springer/Marvin Casebeer.

6:35 p.m.  It was moved and seconded to adjourn the meeting.
