CITY COUNCIL MEETING

December 8, 2004

Anna Bass called the meeting to order at 6:05 p.m.  The roll was called, Lance Delgado,
Karen Jacobs and Jim Hamsher being absent.  The pledge of allegiance was recited.  The
minutes of the November 10, 2004 meeting were considered.  MSP:  To approve the
minutes of the November 10 meeting, Mike Springer/Marvin Casebeer.

The council recognized Brent Smith of the Confederated Tribes of the Warm Springs
Reservation of Oregon.  He said he was requesting the city’s signature on a Land Use
Information Form being submitted for an irrigation consolidation project.  He explained
that the project involves consolidating two points of diversion on the John Day River
(moving one upstream) and that the city’s signature is needed to verify that it does not
conflict with any of its land use rules.  It was generally agreed by the council that the
form should be signed and authorized Anna Bass to do so.  They thanked Smith for
keeping the city informed.  It was noted that the form calls for citing the applicable city
ordinance and the city recorder said she would get the information for Smith the
following day.

The council recognized Sarolta Sperry who addressed them on behalf of the Talents and
Treasures program.  She said she wanted them to be aware of the program and its
purpose; to bring about personal enrichment through the arts.  She said the program has
been very successful in attracting volunteers and participants throughout the area to
Prairie City and that it has already helped to create one cottage business.

6:20 p.m.  Public Hearing:  The public hearing to consider a petition by Chuck Cason to
vacate that portion of Cozart Street between 13th & 14th Streets and tax lots 3000, 3100
and 3200 was opened.  It was noted that the notes submitted by the Planning Commission
recommend the vacation.  Written testimony in favor of vacation from Debbie Letosky on
behalf of Chuck Cason was read (see attached.)  Donita Adams of the Planning
Commission stated that she had voted in favor of recommending vacation of the street
because of the potential benefit to the city and the unlikelihood of the city ever opening

the street due to the drainage.  Joe Hitz suggested the city require a drainage easement in
order to prevent the owner (or future owners) from filling in the area and causing
problems for surrounding properties.  It was noted that Mr. Cason said he would be
available by telephone if there were any questions.  Anna Bass called Cason and
explained the city would be requiring a drainage easement if it were to vacate the street.
He said he would agree to the easement.  It was generally agreed that the city should bear
the cost of drafting the easement and having it recorded.  MSP:  To approve vacation of
that portion of Cozart Street between 13th & 14th Streets, reserving the right to
retain a twenty-foot wide drainage easement and to authorize the city recorder to
draft an ordinance for passage at the December 22 meeting, Mike Springer/Roger
McKinley.

Planning:  No Report

Public Safety:  Officer Wood recited the police, fire and ambulance logs.  He said the
Christmas Basket Program is in need of donations and that the new speed zone signs have
been installed.

Abatement:  The city recorder said she had not yet had time to write a letter to Ms. Larkin
stating the council’s request for a written plan of how and when she would complete the
abatement of her property and asked the council to determine a new deadline.  It was
agreed that Larkin would be given until January 10, 2005 to submit her plan.

Landfill:  No Report

Public Works:  No Report

Well Drilling:  Joe Hitz reported that he had talked with John Coombs about drilling
additional wells on his property.  He indicated that Coombs he said it would be
negotiable and is willing to discuss it.  Hitz was asked about the well testing and he said
that they had attempted to perform a test that day but the generator was not adequate.  He
said the well driller was going to get a different generator and attempt a test the next day.
He also said they should be done in about two weeks.

Accounts Payable:  MSP:  To approve the November/December payables as
presented, Mike Springer/Marvin Casebeer.  The recorder was instructed to ask public
works why they purchased de-icer from the mini mart.

Accruals:  The payroll accruals as of November were presented and it was noted that
none of the employees are over the maximums.

Other Business:  The city recorder told the council that GEODC sent a letter reminding
them their current representative is Tammy Bremner and that if they wish to make any
changes they need to inform them as soon as possible.  The representative (Bremner)
speaks collectively for Long Creek, Canyon city, Dayville, Monument, Mt. Vernon,

Prairie City, Seneca, Granite and John Day.  It was agreed that unless Bremner is not
willing to fulfill the responsibility there is no need to make a change.

The council was reminded that another public hearing is scheduled for December 22,
2004 during the regular council meeting to address a petition by Dennis Lynch and
Norma Rynearson to vacate an alley.

6:55 p.m.  It was moved and seconded to adjourn the meeting.
